Humbly complayning sheweth unto your Lord'pp [Lordshipp] your daylie orator Richard Keyllway, gent. one of the Clarks of Valentine Saunders, esquire, one of the Attornies of his Maj'sts Court of Chancery that whereas Thomas Keyllway of Stoford in the parish of Barwick in the County of Somesett your orators father deceased being in his life time lawfully seized in his demesne as of fee of certaine lands, tenets and hereditaments lying in Barwick and Stoford as aforesaid about twenty years now last past or more did grant an estate for life or lives of part of the land unto one Walter Fry of Barwick aforesaid husbandman by severall leases for the consideracon & personal reservacons in the same leases expressed vizt. by one lease made by your orators said father & Elynor Watts widow likewise deceased your orators grandmother there was granted unto the said Walter Fry and his assignes six acres of land lying & being in the three common fields of Barwick aforesaid in severall places there as the land of other freeholders & tennants of the land of the said parish of Barwick did likewise lye the said six acres & every parcell thereof being severally & distinctly bounded as by the words of the said leases & the counterpart thereof remaining in the hands & custody of the said Walter Fry & whereunto for the better manifestacon of the premises your orator referreth himselfe may more playnly & evidently appeareth also one other lease made by the said Thomas Keyllway about thirty yeares last past unto the said Walter Fry & his assignes for the terme of the naturall lief of him the said Walter Fry only of one close of meadow lying in Barwick aforesaid & conteyning fower acres or thereabouts and whereas your orators father being in his lief time seized of the premisses in fee as aforesaid & by reason of many losses as well by suretishipp as otherwise happening unto him hee the said orators father became indebted unto sundry persons in greate somes of money amounting in the whole to one Thousand pounds & upward being so indebted in the month of July in AnO Dni one thousand six hundred & twelve ~ ~ ~ ~ died intestate att his dwelling house in Stoford aforesaid your orator (being his eldest son & heir) then living in London where your orator (not long before) hearing of his said fathers sickness did as in duty he was bound with much desire & hastened to see his said father lying then sick in Stoford aforesaid being distant from London above C miles, But so it happened that before your orators coming your orators said father was departed his life, And your orators mother & younger brothers receaving the great debt and the personell estate in goods which your said orators father left behind him not to exceed the some of CCl your orators said mother & brothers utterly refused to intermeddle with the said estate, whereuppon your orator for the saving of his said fathers creditt and reputation which no man ever questioned during his lief was content & accordingly made itt knowne that all such debts as were by your orators said father owing either by specyalty or otherwise should bee att reasonable tymes paid & discharged by your orator & for that intent & accordingly made known his purpose of selling certaine quantity of the said lands & some leases then & before belonging to your orator & making offer to the said Walter Fry that hee should buy if he pleased the inheritance of such land as hee had in lease from your orators said father being six acres of arable land & fower acres of meadow as aforesaid, hee the said Fry & your orator could not att their first communicacon agree on the price thereof & thereuppon the said Fry wished your orator to take his best ?chapman? elsewhere making then knowne likewise to your orator that one Henry Wollmington of Hardington in the county of Somersett his son in law was willing to sell away certaine land which he had in Hardington aforesaid to bestow such money as hee should make at the sale thereof in some land or leases lying in Barwick aforesaid if he could & then mov'd your orator to buy of him certaine closes called the Downes lying within ye manor of Barwick which your orator had & held by lease for ye terme of your orators lief & the lief of Andrew Keyllway gent your orators younger brother being the inheritance of one John Simms of Pounceford in the sd county of Somersett Esq. & within a few daies after the sd Walter Fry & the said Wollmington his son in law repaired againe to your orators house & desired from your orator a price of the said leasehold land which your orator did make unto them upon this condicon That hee could entreate & agree with the said John Simms at some reasonable rate for the exchange of ye said 2 lives & adding a 3 whereuppon your orator shortly after riding to ye sd John Simms & moving him there[ ] hee ye said Mr. Simms was altogether unwilling to add any 3 life but would exchange the sd 2 lives for 2 others so that they were neere of ye same age for which your orator should give ye sd Mr. Simms [ ] or after his returne from ye sd Mr. Simms who dwelt almost xx miles from your orator acquainted the sd Fry therewith who againe vizt. about ye xxth of September in do dni 1612 entering into a further communicacon with your orater seemed then desirous to buy some of your orators land of Inheritance as well ye sd 6 acres or on other Tent. then in lease to one Thomas Fry his brother together with ye said leasehold lands called ye Downes for all which a [r________] was then made between your orator & ye sd Walter Fry & ye sd Walter Fry was to pay for ye same unto your orator the some of 400 li or thereabouts which your orator was to receave at these daies following vizt. on the first day of November next following 60li on 25th of December then next ensuing 40 li ; ye 25th of March do Dni. 1613 Cli & ye 24th of June then next following Cli & on ye 20th of September next one other Cli after which agreement so made as aforesd ye sd Walter Fry & Wollmington were desirous & agreed to ride with your orator to the house of one Humfry Coles of Chard in the sd county of Somersett Esquire who had married Elizabeth widow mother to the sd John Simms to crave their good will & assent for ye exchange of ye sd lives as aforesd ye said leasehold parcell of the sd manor of Barwick being then & yet the Joynture of ye sd Eliz. Coles & your orator having obteyned her consent and likewise together with ye sd Fry & Wollmington to ye sd Mr. Simms who then praised and agreed in consideracon of xxli to be paid unto hym by your orator in ye month of Nov. do Dni. 1613 to joyne with his said mother upon surrender of ye sd first lease of the sd closes called ye Downes & to make seales & deliver an other lease of the same for ye heires of him ye said Henry Wollmington & Mary his wife & accordingly your sd orator and his brother Andrew Keyllway did surrender & yield upp all their estate & claim in ye said leasehold lands called ye Downes together with their said lease unto John Dyer gent. now deceased & then steward of ye said manor of Barwick to ye intent aforesd & that by ye appoint'mt & direcon of ye sd John Simms & Hymfry Coles & within a very short time after your orator did seale & deliver unto ye sd Wollmington a deed whereby was conveyed among other lands to the sd Wollmington and his heires ye inheritance of ye said 6 acres of arable land formerly demised to ye sd Walter Fry from your orator & his brother And your orator likewise sheweth that whereas your orators sd father being att the time of his death indebted unto ye sd Humfry Coles in ye other lands to ye sd Wollmington & his heires ye inheritance of ye sd 6 acres of arable land formerly demised to ye sd Walter Fry from your orators father as aforesd And your orator likewise sheweth that whereas your orators said father being att the time of his death indebted unto ye sd Humfrey Coles in ye some of 280li or thereabouts being willing to pay ye same it was likewise agreed with the consent & good liking of him ye sd Walter Fry & Wollmington yt whereas ye sd Fry & Wollmington were to pay unto your orator att our Laday & midsommer next following ye said agree'mt ye severall sums of Cli at each of ye sd feasts yt they ye said Fry & Wollmington should pay ye sd 200li att ye severall time aforesd unto him ye sd Hymfry Coles to & for ye debt of your said orator & should also pay unto the said John Simms ye said some of 20li as aforesaid But the said Fry & Wollmington did not paie the said two hundred pounds to the said Hymfry Coles according to their said [pte. ] by reason whereof your orator was enforced to paie & to the said Hymfry Coles fifty shillings for forebearance of the said [ ] to the said Fry and Wollmington or one of them And who was by the some of 20 & three & [to award?] your orators sd father as he had occascon and many times borrowe from ye sd Hymfry Coles & from Mr. Simms deceased former husband of ye sd Eliz. & whose executrix shee ye sd Eliz. was & also from ye sd Walter Fry divers somes of money to paie his [ ] occacon & entered into [ ] bonds & bills for yt repaymt. of ye sd somes accordingly made paymt. of ye same so yt your orator or his said father to ye said Hymfry Coles nor yet to ye sd Walter Fry as they themsleves well know, and lastly whereas your orator was content at ye making of ye sd bargaine with ye sd Fry & Wollmington to bestow on him ye sd Wollmington at his entreaty divers thinges to the value of 90s [40?] or thereabouts amongst/ /Hymfry Coles nor yet to ye said Walter Fry as they themsleves well know and lastly whereas yor orator was content at ye making of ye sd bargain with ye said Fry & Wollmington to bestow on him ye sd Wollmington at his entreaty divers thinges to the value 90s [40?] or thereabouts & amongst ye rest one mowstadle(?) whollie furnished then standing uppon pte. of ye sd leasehold ground where also stood one other mowstadle which your orator reserved for his own use And whereas ye sd H. Wollmington having a conveyance from your orator of the said 6 acres of arable land as aforesd in which conveyance ye 6 acres are granted so they are bounded in ye sd Walter Fry's lease whereas in truth is ye same [wrinkle] sd six acres were exchanged for other land with ye consent aforesd of your orators said father as of ye sd Walter Fry & which lands so taken in exchange hee ye sd Walter Fry at ye time of ye sd conveyance made & did hold & enjoy of which exchange your orator was the [wrinkle] alto______ ignorant and it was intended _______ by your orator that such lands as were in the possession of the said Walter Fry or his assigns att the tyme of the said bargain made for the said six acres should be held by your orator & none other yet so itt is may it please your Lord'pp yt ye sd Henry Wollmington giveth out in speech yt hee will enter uppon such lands above mentioned upon his sd deeds will enjoy or otherwise bring his accon of covent against your orator & thereby compell your orator to make good ye sale of ye sd six acres so conveyed unto him as aforesd & also ye sd land taken in exchange & held by ye sd Walter Fry as aforesd contrary to right equity & good conscience And because they the sd Wollmington & W. Who is Draper Miller (wife Ursula) and brothers Hugh & Edward?

Richard named Giles Phelpes gent. as one of his overseers. Is he Giles Phelpes, son of the Giles Phelips & Jane Keylway, d/o of Henry K. who inherited Lillington? The elder Giles Phelpes was buried at Barwick; the younger Giles was christened there.

One must wonder why Brother Robert and Walter Ridott "renounced" administration of Richard's will.
